Enter for a chance to win two (2) tickets to the domestic premiere of MoveOn: The Movie ("Premiere") in either New York, Washington D.C. or Los Angeles! Trip includes domestic roundtrip airfare for two (2) and a two (2) night stay at a hotel near the Premiere!
  1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANGES OF WINNING.
  2. SPONSOR: Brave New Films, 10510 Culver Blvd., Culver City, CA 90232. "Sponsor" shall mean Brave New Films and its respective affiliates and employees.
  3. ELIGIBILITY: Sweepstakes is open only to permanent legal residents of the fifty (50) states of the U.S. (excluding Puerto Rico) and the District of Columbia who are physically located and residing therein, and who are eighteen (18) years of age or older as of July 24, 2009. SWEEPSTAKES IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Entrants are subject to all applicable federal, state and local laws. Employees of Brave New Films, Brave New Foundation and each of their respective affiliates and employees and the immediate family members and persons living in the same household of each are not eligible to enter or win.
    MUST BE ABLE TO TRAVEL TO NEW YORK, WASHINGTON D.C. OR LOS ANGELES FOR A TWO (2) TO THREE (3) DAY PERIOD TO ATTEND THE PREMIERE COMMENCING ON OR AROUND AUGUST 25 - SEPTEMBER 4, 2009.
  4. HOW TO ENTER: This Sweepstakes begins at 9:00:01 a.m. Pacific Standard Time ("PST") on July 24, 2009, and ends 11:59:59 p.m. PST on August 10, 2009 ("Sweepstakes Period"). Entries submitted outside of this Sweepstakes Period will not be accepted. To enter the Sweepstakes, go to http://moveonmovie.com and enter your first and last name, e-mail address, phone number, home address and your 'Favorite MoveOn Moment', and click on the "Submit" button (each an "Entry"). Entries are limited to one Entry per person.
  5. POTENTIAL WINNER SELECTION AND NOTIFICATION: From all eligible Entries received, the Sponsor will select one (1) potential Grand Prize winner in a random drawing on August 11, 2009 ("Potential Grand Prize Winner"). The Sponsor's decisions are final and binding on all matters relating to the Sweepstakes. The Potential Grand Prize Winner will be notified via e-mail (the "Prize Notification") within two (2) calendar days of the date of selection and he/she must respond by e-mail to the e-mail address provided in the Prize Notification within (1) calendar day of the date of the Prize Notification (the "Deadline"). If the Potential Grand Prize Winner does not respond by the Deadline, he/she will be disqualified and an alternate winner will be selected from all remaining eligible entries received for the original drawing, time permitting ("Alternate Potential Grand Prize Winner"). Once Sponsor receives the Potential Grand Prize Winner's response e-mail, an Affidavit of Eligibility and a Liability/Publicity Release (collectively, the "Sweepstakes Documents") will be sent to the Potential Grand Prize Winner via electronic and/or overnight mail. The Potential Grand Prize Winner must sign and return the Sweepstakes Documents postmarked within [three (3) days] of the date of receipt of the Sweepstakes Documents, or all prizes will be forfeited and an Alternate Potential Grand Prize Winner selected, time permitting. The Sweepstakes Documents will be void if all information required is not provided. Only original Sweepstakes Documents will be accepted; no duplicates are allowed. Do not allow anyone to use or copy your Sweepstakes Documents. You should retain a copy of the Sweepstakes Documents for your records. Sponsor is not responsible for the failure, for any reason whatsoever, of any Potential Grand Prize Winner to receive the Sweepstakes Documents or for Sponsor to receive Potential Grand Prize Winner's response and/or Sweepstakes Documents. The return of any Sweepstakes Documents or any other correspondence (including, without limitation, electronic correspondence) as undeliverable, the inability of Sponsor to contact Potential Grand Prize Winner or the failure of Potential Grand Prize Winner to contact Sponsor in a timely manner will result in disqualification, and an Alternate Potential Grand Prize Winner will be selected, time permitting. All Potential Grand Prize Winners and Alternate Potential Grand Prize Winners are subject to verification by Sponsor, whose decisions are final and binding in all matters related to the Sweepstakes. An entrant is not the winner of any prize, even if the Sweepstakes or Sponsor so indicates, unless and until entrant's eligibility and selection as a winner have been verified and that entrant has been notified that verification is complete. Sponsor shall repeat the winner selection and verification procedures set forth in this Section 5, time permitting, until one (1) qualified Grand Prize winner has been selected and verified (the "Grand Prize Winner").
  6. PRIZES AND ODDS OF WINNING: Odds of winning the Grand Prize depend on the total number of eligible Entries received during the Sweepstakes Period. Only one (1) Grand Prize will be awarded. There are no other prizes. The Grand Prize Winner will be eligible to receive: (i) two (2) round trip coach airfares between the U.S. major metropolitan city airport closest to the Grand Prize Winner's residence (or another airport of Sponsor's choice in its sole discretion) ("airport of origin") and an airport in [Los Angeles, New York City or Washington D.C.] chosen by Sponsor on such dates, times, itinerary and airline(s) as Sponsor may determine in its sole and absolute discretion; (ii) two (2) nights hotel accommodations at a hotel situated near the Premiere, such hotel to be determined by Sponsor in its sole and absolute discretion and (iii) two (2) tickets to the Premiere of MoveOn.org The Movie that will in the period of August 25 - September 4, 2009 in [Los Angeles, New York City or Washington D.C.] (collectively, the "Grand Prize"). Sponsor will advise of specific date at time of notification. Total combined Grand Prize Approximate Retail Value ("ARV") is US$3500.00, which will vary depending upon the points of departure and destination and seasonal fluctuation of airfares. All expenses not specifically mentioned herein are not included and are solely the Grand Prize Winner's responsibility, including but not limited to: round trip transportation between the Winner's residence and any airport or origin, ground transportation costs in [Los Angeles, New York City or Washington D.C.], room service, laundry, parking, meals, alcoholic beverage, telephone calls, merchandise, souvenirs, taxes, tips, gratuities, service charges, or any other service or item not specifically described above. Airline carrier regulations and conditions apply. Airfare is subject to availability. The Grand Prize Winner must be available to travel in the period of August 25 - September 4, 2009 or the Grand Prize will be forfeited and an Alternate Potential Grand Prize Winner selected, time permitting.
  7. PRIZE CONDITIONS: Each element of the Grand Prize is subject to availability. Sponsor is not responsible for circumstances that make it impractical or impossible to fulfill any or all elements of the Grand Prize; and Sponsor's only obligation will be to provide the remaining elements, if any, of the Grand Prize. No element of the Grand Prize is transferable, and no cash redemption or prize substitution is allowed, except by the Sponsor, who reserves the right, in its sole discretion, to substitute the cash value of any prize included in the Grand Prize, or another prize it believes is of equal or greater value. ALL PRIZES INCLUDED IN THE GRAND PRIZE ARE AWARDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) TO THE MAXIMUM EXTENT ALLOWABLE BY LAW. ACCEPTANCE, PARTICIPATION IN AND/OR USE OF THE GRAND PRIZE IS AT THE GRAND PRIZE WINNER'S SOLE RISK AND SPONSOR IS NOT RESPONSIBLE FOR ANY DAMAGES OR PERSONAL INJURY WHATSOEVER, INCLUDING BUT NOT LIMITED TO SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE USE AND/OR MISUSE OF ANY ELEMENT OF THE GRAND PRIZE. Sponsor reserves the right (in its sole and absolute discretion) to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.
  8. TAXES AND COSTS RELATED TO THE PRIZES: All applicable taxes and fees and any license, destination and delivery charges on and in connection with the Grand Prize, including, but not limited to, income taxes, sales taxes, federal, state, provincial, or local taxes, customs fees, duties, and the like are the sole responsibility of the Grand Prize Winner. The Grand Prize Winner may be issued a 1099 tax form for the ARV of the Grand Prize.
  9. DISCLAIMERS: By entering the Sweepstakes, entrants acknowledge and agree (a) to be bound by these Official Rules (the "Official Rules" or "Rules"), Sponsor's On-Line Privacy Policy, which can be found at [http://], all applicable laws and the decisions of Sponsor, which are final and binding in all respects; (b) to waive any rights to claim any ambiguity in the Rules; and (c) that the Sponsor shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with the following: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of Entry information; acceptance/possession, use/misuse, and/or defects of any prize awarded herein; any technical malfunctions of the telephone network, computer online system, computer equipment, software, or internet service provider utilized by Sweepstakes; interruption or inability to access Sweepstakes, website, or any online service via the internet due to hardware or software compatibility problems; any damage to entrant's (or any third person's) computer and/or its contents related to or resulting from any part of this Sweepstakes; lost, late, postage-due, misdirected, or undeliverable mail or electronic mail; any lost/delayed data transmissions, omissions, interruptions, defects and/or any other errors or malfunctions, even if any of the foregoing are caused by the negligence of Sponsor. By entering, entrants and winners further agree to release, discharge, indemnify and hold harmless the Sponsor and its respective divisions, directors, employees, officers and agents from any and all claims, demands, damages, losses, liabilities, costs or expenses due to any injuries, damages or losses to any person (including death) or property of any kind resulting or arising, in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize or participation in the Sweepstakes or any Sweepstakes-related activity, to release all rights to bring any claim, action or proceeding against the Sponsor, and hereby acknowledge that said Sponsor has neither made nor is in any manner responsible or liable for any representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a prize supplier that may be sent along with a prize. Mass Entries and Entries that are illegible, late, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, or otherwise not in compliance with these Official Rules, will be disqualified and the Sponsor is not responsible or liable for any such Entries.
  10. GENERAL CONDITIONS: By accepting the Grand Prize, the Grand Prize Winner consents to the use of the Grand Prize Winner's name and/or likeness (voice, biographical information, city and state of residence, statements, photograph, and/or recordings) for advertising and promotional purposes without additional compensation (except if winner is a resident of TN or where prohibited by law). Sponsor reserves the right to modify, amend or make changes or additions to these Official Rules and/or extend the dates of this Sweepstakes for any or no reason at any time without notice. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  11. USE OF PERSONAL INFORMATION: In order to participate in this Sweepstakes, entrants are required to supply information on the Sweepstakes entry page. Information collected in this Sweepstakes includes first and last name, e-mail address, phone number and home address. Sponsor has specified which information is mandatory in order to participate in the Sweepstakes. This information will be used by Brave New Films for the purposes of administering the Sweepstakes. [Entrant will also have the option of signing up for e-mail updates from Brave New Films.] Subscribing to Brave New Films e-mail updates does not increase or affect an entrant's chances of winning. Entrant can unsubscribe from Brave New Films e-mail updates at any time without affecting his/her chances of winning.
  12. CAUTION: If for any reason the Sweepstakes is not capable of running as planned, including infection due to computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right to disqualify any individual who tampers with the entry process, operation of the Sweepstakes or web site, and to cancel, terminate, modify, or suspend the Sweepstakes without notice and/or to select an Alternate Potential Grand Prize Winner from all eligible Entries received prior to the cancellation or termination, time permitting. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, problems or technical malfunctions of any computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or Entry to be received by Sponsor on account of human error, technical problems or traffic congestion on the Internet or at any website, theft or destruction, or unauthorized access to, or tampering with or hacking of website, any combination thereof, or otherwise, including any injury or damage to any entrant's or any other person's computer related to or resulting from participation in the Sweepstakes. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
  13. DISPUTES: Each entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in Los Angeles County, California; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys fees; and (C) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES, AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and the Sponsor in connection with this Sweepstakes shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than those of the State of California.
